1. Welcome to Dochours

Thank you for choosing Dochours, a comprehensive clinic management solution provided by Zennode Technologies LLP (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access and use of Dochours. By accessing or using Dochours, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use Dochours.

2. Who Can Use Dochours

Dochours is designed exclusively for healthcare professionals and their authorized staff members. It streamlines clinic operations, patient record management, appointment scheduling, and associated administrative tasks.

3. Using Dochours Responsibly

3.1. Permitted Use

You may use Dochours only for lawful purposes and in accordance with these Terms. This includes managing:

  • Clinic operations (scheduling, billing)
  • Patient records
  • Appointments (online scheduling, confirmations, reminders)
  • Administrative tasks

3.2. Prohibited Activities

You agree to refrain from any activity that:

  • Violates laws or regulations related to patient privacy, data protection, or healthcare administration.
  • Disrupts or interferes with Dochours’ operation, servers, or networks.
  • Attempts unauthorized access to Dochours or other systems.
  • Damages, disables, or overloads Dochours’ functionality.
  • Uses data mining, robots, or similar methods to extract data from Dochours.

4. User Accounts

4.1. Account Creation

To access Dochours, you must create an account with accurate, current, and complete information. Keep your account information updated for accuracy. You are responsible for maintaining the confidentiality of your login credentials and any activity under your account.

4.2. Authorized Users

Access to Dochours is restricted to authorized staff within your clinic. Each authorized user must have unique login credentials.

5. Intellectual Property Rights

All Dochours content (text, graphics, logos, etc.) belongs to Zennode LLP or its licensors. These materials are protected by copyright, trademark, and other intellectual property laws. You cannot use, copy, reproduce, modify, translate, distribute, or create derivative works from Dochours content without written consent.

6. Data Security and Privacy

6.1. Data Security

Zennode LLP is committed to protecting the privacy and security of your data. Your use of Dochours is subject to the Dochours Privacy Policy, which details how your information is collected, used, and protected. We employ robust security measures to safeguard your data, adhering to industry best practices.

6.2. Patient Confidentiality

You are responsible for ensuring the confidentiality of patient information stored within Dochours. You must comply with all relevant privacy laws and regulations regarding patient data.

7. Limitation of Liability

In no event will Zennode LLP or its affiliates, licensors, suppliers, or agents be held liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Dochours. This includes, but is not limited to, lost profits, lost data, or business interruption.

8. Term and Termination

This Agreement and the software license granted hereunder shall become effective from the effective date and shall continue for a period of one month or year based on the plan chosen.

Zennode LLP may also terminate this Agreement and your access to Dochours upon breach of these Terms or for any other reason.

9. Refund Policy

The Company understands that there may be circumstances where the client needs to cancel their subscription to the SaaS Solution and requests a refund. The client is eligible for a 60 days no question asked refund policy. The Clinic Owner may request a refund for any reason within the first 60 days of the Effective Date. The Clinic Owner may be eligible for a refund if:

  • The Clinic Owner cancels their subscription within 60 days of the Effective Date.
  • The SaaS Solution does not meet the specifications described in the Service Agreement.
  • The SaaS Solution is unavailable for more than 24 hours during the client’s billing cycle.
  • The Clinic Owner is not in breach of any obligations under the Service Agreement.
  • To request a refund, the Clinic Owner must submit a written request to the Company within the refund eligibility period. The request must include the reason for the refund request and any supporting documentation. Upon receipt of the refund request, the Company will review the request and determine whether the Clinic Owner is eligible for a refund. If the Clinic Owner is eligible, the Company will issue a refund within 30 days of the determination.

The refund will be issued to the original payment method used by the Clinic Owner. The Company reserves the right to deduct any applicable fees or charges from the refund amount.

10. Governing Law

These Terms of Service are governed by and interpreted according to the laws of India, excluding its conflict of law principles.

11. Changes to These Terms

Zennode LLP reserves the right to update or modify these Terms at any time without prior notice. Any changes become effective immediately upon posting on Dochours. Your continued use of Dochours after such updates signifies your acceptance of the changes.

12. Backups and Data Ownership

Dochours performs regular backups of your data to ensure its safety and availability. You retain full ownership of all data you store within Dochours, including patient records, appointment details, and clinic information.

13. Service Level Agreement (SLA)

Zennode LLP may offer an optional SLA outlining uptime guarantees, support response times, and service credits for downtime exceeding agreed-upon thresholds.

14. Third-Party Services

Dochours may integrate with third-party services for functionalities like appointment reminders or online payments. Your use of these services is subject to their separate terms and conditions. Zennode LLP is not responsible for the practices or privacy policies of third-party services.

15. Feedback and Suggestions

We appreciate your feedback and suggestions for improving Dochours. You may submit feedback through the Dochours platform or by contacting support. We reserve the right to implement your feedback at our sole discretion.

16. Entire Agreement

These Terms, along with the Dochours Privacy Policy, constitute the entire agreement between you and Zennode LLP regarding your use of Dochours.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

18. Additional Considerations

  • Payment Terms: Dochours offers paid subscription plans, the specific terms regarding payment methods, fees, refunds, and taxes will be clearly outlined on the Dochours website and in your subscription agreement.
  • Compliance with Laws: You are responsible for ensuring your use of Dochours complies with all applicable laws and regulations, including those related to data privacy and healthcare administration.
